Can't think of a more broken method. Red Hat recommends using rpm -q 
redhat-release to detect version, but reading /etc/redhat-release is 
perhaps the most used method.

Typically there are multiple kernels installed, so rpm -q 
--queryformat=%{vendor} kernel-`uname -r` should be used. If not, the 
check is easily fooled. What is interesting, is whether it is checked 
during the installation or also when the program is started.

You could install a kernel from RH9 or FC3, install arcserve and 
optionally remove the kernel. Another option is to create an empty rpm 
package.
